On January 13 Commerce issued its final determination in the antidumping duty investigation of certain orange juice from Brazil for the period October 1, 2003 through September 30, 2004. Commerce also determined there was a reasonable basis to believe critical circumstances exist for imports produced by Sucocitrico Cutrale, S.A., Montecitrus Trading S.A and companies covered by the “All Others” rate.
On February 27 the International Trade Commission (ITC) notified Commerce of its final determination. Though it agreed domestic producers are materially injured it determined critical circumstances do not exist.
Cash deposits for the subject merchandise are required for the estimated weighted-average antidumping duty margins as below. For not-from-concentrate, the “all others” rate applies to all companies not specifically named below. However, for frozen concentrate for manufacture, the “all others” rate only applies to FCOJM produced and/or exported by Cargill and Coinbra-Frutesp.
