HTS Modifications
These modifications change the tariff classification of the identified articles but do not change the duty rates applicable to these articles.

President Bush proclaimed certain modifications to the Harmonized Tariff Schedule of the United States (HTSUS). These modifications follow recommendations by the United States International Trade Commission intended to conform the HTSUS to amendments made to the International Convention on the Harmonized Commodity Description and Coding System. The modifications are effective with respect to imports that enter the United States or are withdrawn from warehouse for consumption on or after Feb. 3.

Jeff Levin has identified several modifications to the HTSUS that may be of interest to AFI members. Note these modifications change the tariff classification of the identified articles but do not change the duty rates applicable to these articles.

1. Fresh or Chilled Globe Artichokes

The modifications will delete the following current HTSUS subheading:

0709.10.00 (Other vegetables, fresh or chilled: Globe artichokes).

and insert the following new HTSUS subheading in numerical sequence:

0709.90.65 (Other vegetables, fresh or chilled: Other: Globe artichokes)

2. Mushrooms and Truffles

The modifications will delete the current HTSUS subheading:

0709.52.00 (Other vegetables, fresh or chilled: Mushrooms and truffles: Truffles)

and will supersede the current HTSUS subheading 0709:59.00 (Other vegetables, fresh or chilled: Mushrooms and truffles: Other) by the following new HTSUS subheadings:

0709.59.10 (Other vegetables, fresh or chilled: Mushrooms and truffles: Other: Truffles); and

0709.59.90 (Other vegetables, fresh or chilled: Mushrooms and truffles: Other: Other).

3. Provisionally Preserved Capers

The modifications will delete the following current HTSUS subheading under heading 0711 (Vegetables provisionally preserved (for example, by sulfur dioxide gas, in brine, in sulfur water or in other preservative solutions), but unsuitable in that state for immediate consumption):

0711.30.00 (Capers)

and insert the following new HTSUS subheading in numerical sequence:

0711.90.30 (Other vegetables; mixtures of vegetables: Capers)

4. Macadamia Nuts

The modifications will insert the following new HTSUS subheadings for these articles in numerical sequence:

0802.60 (Other nuts, fresh or dried, whether or not shelled or peeled: Macadamia nuts)

0802.60.40 (In shell)

0802.60.40 (Shelled)

Also, the modifications will renumber current HTSUS subheadings 0802.90.80 and 0802.90.98 as HTSUS subheadings 0802.90.81 and 0802.90.97, respectively.

5. Fresh or Dried Citrus Fruit

The modifications will change the article description of HTSUS subheading 0805.40 from “Grapefruit” to “Grapefruit, including pomelos”.

6. Berries and Other Fruit

The modifications will delete the following current HTSUS subheading:

0810.30.00 (Other fruit, fresh: Black, white or red currants and gooseberries (other than kiwi fruit).

The modifications will renumber current HTSUS subheading 0810.90.25 (Other fruit, fresh: Other: Berries and tamarinds ) as new HTSUS subheading 0810.90.26, and will change the article description for this subheading to the following:

“Black, white or red currants and gooseberries (other than kiwi fruit) and other berries; tamarinds”.

7. Cinnamon

The modifications will supersede the following current HTSUS subheading:

0906.10 (Cinnamon and cinnamon-tree flowers: Neither crushed nor ground)

by the following two new HTSUS subheadings:

0906.11.00 (Cinnamon and cinnamon-tree flowers: Neither crushed nor ground: Cinnamon (Cinnamomum zeylanicum Blume)); and

0906.19.00 (Cinnamon and cinnamon-tree flowers: Neither crushed nor ground: Other)

8. Certain Spices

The modifications will delete the following current HTSUS subheadings under heading 0910 (Ginger, saffron, turmeric (curcuma), thyme, bay leaves, curry and other spices):

0910.40.20 (Thyme; bay leaves: Crude or not manufactured);

0910.40.30 (Thyme; bay leaves: Other: Thyme);

0910.40.40 (Thyme; bay leaves: Other: Bay leaves); and

0910.50.00 (Curry)

and insert the following new HTSUS subheadings in numerical sequence:

0910.99.05 (Other spices: Other: Thyme; bay leaves: Crude or not manufactured);

0910.99.06 (Other spices: Other: Thyme; bay leaves: Other: Thyme);

0910.99.07 (Other spices: Other: Thyme; bay leaves: Other: Bay leaves); and

0910.99.10 (Other spices: Other: Curry)

Preserved or Prepared Vegetables

The modifications state that the current HTSUS subheading 2005.90 (Other vegetables prepared or preserved otherwise than by vinegar or acetic acid; not frozen, other than products of heading 2006: Other vegetables and mixtures of vegetables) and the following subheadings thereunder:

2005.90.10 (Carrots in airtight containers);

2005.90.20 (Onions);

2005.90.30 (Sauerkraut);

2005.90.41 (Water chestnuts, other than Chinese water chestnuts);

2005.90.50 (Fruits of the genus Capsicum (peppers) or the genus Pimenta (e.g., allspice): Pimientos (Capsicum annum));

2005.90.55 (Fruits of the genus Capsicum (peppers) or the genus Pimenta (e.g., allspice): Other);

2005.90.60 (Bamboo shoots in airtight containers);

2005.90.80 (Artichokes);

2005.90.85 (Chickpeas (garbanzos)); and

2005.90.97 (Other);

are superseded by the new HTSUS subheading 2005.91 (Other vegetables prepared or preserved otherwise than by vinegar or acetic acid; not frozen, other than products of heading 2006: Other vegetables and mixtures of vegetables: Bamboo shoots) and the following subheadings thereunder:

2005.91.60 (In airtight containers); and

2005.91.97 (Other)

and by the new HTSUS subheading 2005.99 (Other vegetables prepared or preserved otherwise than by vinegar or acetic acid; not frozen, other than products of heading 2006: Other vegetables and mixtures of vegetables: Other) and the following subheadings thereunder:

2005.99.10 (Carrots in airtight containers);

2005.99.20 (Onions);

2005.99.30 (Sauerkraut);

2005.99.41 (Water chestnuts, other than Chinese water chestnuts);

2005.99.50 (Fruits of the genus Capsicum (peppers) or the genus Pimenta (e.g., allspice): Pimientos (Capsicum annum));

2005.99.55 (Fruits of the genus Capsicum (peppers) or the genus Pimenta (e.g., allspice): Other);

2005.99.80 (Artichokes);

2005.99.85 (Chickpeas (garbanzos)); and

2005.99.97 (Other).
