New Shipper
The Department of Commerce initiated new shipper reviews covering the period February 1, 2008 through July 31, 2008 for mushrooms from China produced and exported by Zhejiang Iceman Group Co., Ltd. (Zhejiang Iceman) and Zhangzhou Gangchang Foods Co., Ltd. (Zhangzhou Gangchang).
The posting of a bond in lieu of a cash deposit is not available. Importers of subject merchandise must continue to pay a cash deposit of estimated antidumping duties on each entry at the current PRC-wide rate of 198.63 percent.
Preliminary results are due in April.
Court of International Trade (CIT) Decision
As a formality, Commerce published a notice saying that a decision by the U.S. Court of International Trade is "not in harmony" with Commerce's results of an administrative review on the mushroom antidumping duty order for Feb. 1, 2001 through Jan. 31, 2002.
Commerce cited "adverse facts available" and determined rates for Gerber and Green Fresh for that period should be 198.63 percent. The court found fault in Commerce's reasoning. Commerce then determined the rate should be 92.11 percent for Gerber and 31.55 percent for Green Fresh. By law, Commerce had to publish today's notice to inform the public the Court of International Trade approved of the methodology used to determine the new rates. Liquidation of entries from these companies for the time period in question will continue to be suspended until the period for an appeal expires or until an appeal is conducted and a final decision is rendered.
